These Terms of Use (“Terms”) govern your use of www.boldfish.co (the “Website”), operated by myCTO Live, which runs the Boldfish brand (“Boldfish”, “we”, “us”), with its registered office at 23, Madha Koil Street, Nellithope, Puducherry – 605 005, India. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. What the Website is for

The Website introduces Boldfish, our practices — Capital Narrative, Brand Narrative and Visual Narrative — our studios Kayak Films and Boldfish AI, our work and our journal. It is provided for general information only.

Nothing on the Website is an offer to provide services, and nothing on it is financial, investment, legal or other professional advice. Any work we do for you will be governed by a separate written engagement agreement, which will take precedence over these Terms.

2. Using the Website

You may browse, read and share links to the Website for your own personal or internal business purposes. You agree not to:

• use the Website in any way that breaks the law or infringes anyone’s rights;
• copy, scrape or republish substantial parts of the Website, or use its content to train machine-learning or AI models, without our written permission;
• attempt to gain unauthorised access to the Website, its servers or any connected system, or interfere with its operation; or
• send us anything that is unlawful, misleading, harmful or contains malicious code.

3. Intellectual property

The Website and its content — including text, design, graphics, illustrations, films, images, the Boldfish name and logo, and the names and marks of Kayak Films and Boldfish AI — are owned by Boldfish or licensed to us, and are protected by copyright, trade mark and other laws.

Work shown in our case studies may belong to our clients and is displayed with their permission. Client names, logos and trade marks belong to their respective owners, and their appearance on the Website does not imply that they endorse anything beyond the work described.

Except as these Terms allow, you may not use any content from the Website without our prior written consent. To ask for permission, write to hello@boldfish.co.

4. What you send us

When you contact us through the Website, please share only what is needed for a first conversation. Information sent through the contact form is not treated as confidential until we have agreed in writing to keep it confidential, for example by signing a non-disclosure agreement. We will, however, handle any personal data you send in line with our Privacy Policy.

If you send us ideas, suggestions or feedback about the Website or our services, you agree that we may use them without any obligation to you.

5. Third-party links

The Website contains links to websites we do not control, including social media platforms and our clients’ websites. We are not responsible for their content, availability or privacy practices, and a link does not mean we endorse them.

6. Accuracy and availability

We work to keep the Website accurate and up to date, but we do not guarantee that all content is complete, current or error-free. Figures such as amounts raised or work delivered describe past results; they do not promise any particular outcome for future work.

We may change, suspend or withdraw any part of the Website at any time without notice. We do not guarantee that it will always be available or free of viruses, so please use your own security protections.

To the fullest extent permitted by law, the Website is provided “as is” and “as available”, without warranties of any kind. Boldfish will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data, business or goodwill, arising from your use of, or inability to use, the Website or its content.

Where liability cannot be excluded, our total liability to you in connection with the Website is limited to INR 10,000. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Indemnity

You agree to indemnify Boldfish against any claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Website.

9. Privacy

Our Privacy Policy explains how we collect and use personal data through the Website, and forms part of these Terms.

10. Changes to these Terms

We may update these Terms from time to time by publishing a new version on the Website. The “Last updated” date shows when they were last changed. Your continued use of the Website after a change means you accept the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of India. The courts at Chennai, India will have exclusive jurisdiction over any dispute arising from them or from your use of the Website.

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our not enforcing a right does not mean we have given it up.
